4. PAYMENT METHOD
Payments will be made securely through the Iyzico payment infrastructure, protected by 3D Secure. The BUYER acknowledges that they accept the Seller's authority to collect the Product/Service fee once the payment process is completed.
5. DELIVERY / PERFORMANCE METHOD AND DURATION
The Product/Service subject to this form is digital in nature and will be opened for instant access following the successful completion of the BUYER's order confirmation and payment process. The BUYER can access the Product/Service through the access information sent via the Platform or by email. Since the delivery takes place in the form of electronic access, there is no physical delivery and no shipping fee.
6. RIGHT OF WITHDRAWAL AND EXCEPTIONS
6.1. The BUYER has the right of withdrawal from the contract without stating any reason and without paying a penalty within 14 (fourteen) days in accordance with the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.
6.2. However, in accordance with Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised in the following situations:
* Contracts regarding services for which performance has begun with the consumer's consent before the withdrawal period has expired.
* Contracts regarding services performed instantly in electronic environment or intangible goods delivered to the consumer immediately.
* Contracts concerning books, digital content, and computer consumables presented in tangible medium that have had their protective elements such as packaging, tape, seal, or package opened after delivery of the goods.
* Therefore, for the digital subscriptions, online consultations, and services provided by the SELLER, the right of withdrawal will end with the BUYER's access to the service or the downloading/usage of the content.
* The BUYER explicitly accepts and declares that they will lose the right of withdrawal with the instant performance of the digital content by approving this order.
6.3. Subscription Cancellation: The BUYER has the right to cancel their subscription before the next renewal date. In case of subscription cancellation, the service can be continued until the end of the current subscription period; the fee collected for the current period will not be refunded, but no fee will be charged for the next subscription period. The BUYER can notify the cancellation request through the Platform or by sending an email to hello@myleap.co.
7. RETURN PROCESS AND REFUND
7.1. Except for exceptions to the right of withdrawal, if the BUYER's return request is approved by the SELLER, the amounts paid will be refunded to the BUYER within a maximum of 14 (fourteen) days.
7.2. Refunds for payments made by credit card or bank card are made to the same card, depending on the processes of the relevant bank. Due to reasons arising from the banks' internal operations, the time for the refund to reflect in the BUYER's account may vary.
7.3. In payments made by Money Transfer/EFT, the refund is made to the bank account notified by the BUYER when placing the order.
8. COMPLAINT AND DISPUTE RESOLUTION
8.1. The BUYER can submit their complaints regarding the Product/Service to the SELLER's customer service email address hello@myleap.co.
8.2. It is recommended to seek a solution through good faith discussions in case of disputes arising from this contract. If no solution is reached, in case the BUYER is considered a consumer under the Consumer Protection Law No. 6502, the Consumer Arbitration Committees or Consumer Courts in the BUYER's place of residence will be authorized. For disputes falling within the jurisdiction of the Consumer Courts, the Consumer Courts in the BUYER's place of residence and the Istanbul (Anadolu) Consumer Courts, where the SELLER is located, are also authorized. If the BUYER is not considered a consumer under the Law No. 6502, the Istanbul (Anadolu) Courts and Execution Offices are authorized.
9. PROTECTION OF PERSONAL DATA AND PRIVACY POLICY
The SELLER processes the BUYER's personal data in accordance with the Personal Data Protection Law No. 6698 and related legal regulations. Detailed information regarding the protection of the BUYER's personal data can be found in the Privacy Policy at www.myleap.co/kvkk and in the Clarification Text at www.myleap.co/gizlilik-politikasi.
10. ESTABLISHMENT AND STORAGE OF ELECTRONIC CONTRACT
This Pre-Information Form and Distance Sales Contract are considered to have been concluded and entered into force electronically upon the BUYER's approval of the order via the Platform. The BUYER acknowledges that they will be presented with these documents through a permanent data storage device (e.g., by email or downloadable PDF) and will have the opportunity to store them.
11. OTHER PROVISIONS
The SELLER may update this Pre-Information Form and Distance Sales Contract at any time depending on business requirements and legal regulations. The updated text comes into effect on the date it is announced on the Platform.
